Attorney Answers Ventura County Car Accident QuestionI was in a car accident in Ventura county, CA. After receiving $15,000 from the other driver's insurance, can I ask and receive the remaining amount from my insurance company without arbitration? I was involved in an auto accident in Ventura county CA. I am 57 yoa and I was the front passenger of one of my family cars that was rear ended on the frwy. The other driver had limited insurance coverage of $15,000. With my previous existing pain caused by Fibromyalgia and Arthritis, my pain has worsen. I now have frequent numbness in my left fingertips with pain all the way up to my left shoulder and shoulder blade. Right knee pain and other previous existing medical conditions now have also worsen. Can I recover the other $15,000 from my auto insurance without going to arbitration?
Attorney's Response to Car Accident Question from Ventura CountyI assume you are referring to uninsured/underinsured motorist coverage on your policy. You can certainly make a claim if your expenses are over and above the $15K you settled for with the other driver's insurance (the policy limits) for this car accident. Like the other insurer, however, you will have to prove that the expenses you are presenting are related to the accident and were reasonable and necessary. It is often difficult to prove when you have pre-existing injuries or conditions. They will likely send you for an indpendent medical exam and their medical expert will probably attribute most if not all of your pain to your pre-existing condition.
