Basically I was traveling down I-95 in Palm Beach County, Florida, and was rear ended by a drunk driver traveling well over 100mph spinning my car out for 100 feet into the guardrail totaling it Then then the drunk driver left the scene, tried to get away only to be found miles down the interstate in a ditch because of the damages to his car and himself. The reason I ask is moments later a semi truck struck my totaled disabled car finishing it off and the drunk driver left me and my passenger for dead. Attorney's Response to Car Accident Question from Palm Beach CountyFirst, although you state that you and your passenger only received minor injuries, you need to elaborate further on your injuries in order to determine the merits of your potential claim. Were you treated by a doctor? Did you have whiplash? Did you have visible cuts/bruises? These types of injuries, although minor when put in perspective, could still justify bringing a personal injury claim. Second, although you state that you were hit by a drunk driver, you also state that you wish to press charges on him. This does not make sense. How do you know he was drunk if he was not arrested? If, on the other hand, he was arrested, it is unnecessary for you to "press charges", because he was already arrested. Rather, you would be the "victim" in his pending criminal case. Proceeding forward, I suggest that you obtain a copy of the police report (that should identify the drunk driver as well as the driver of the semi truck, as well as their respective insurance policies) and then consult with an attorney who will be able to advise you with respect to the merits of any and all claims that you may have against each driver, as well as your rights with respect to being a victim in a pending criminal matter.
