Attorney Answers Bronx County Car Accident QuestionA bus hit my car and I was badly hurt. Should I have a lawyer sue in the Bronx, NY where I live, or in Philly where the car accident happened? I was hurt and hospitalized and will walk with a limp. My car was also totalled. Greyhound is offering to cover the medical bills only. I spoke to a lawyer in Philly but my friends think I should use a lawyer and sue the bus company here in the Bronx. Should I speak to a car accident attorney from the Bronx or stay with the Philly car accident lawyer?
Attorney's Response to Car Accident Question from Bronx CountyIf you hire a car accident attorney in Philly she will normally want to sue there. She's probably not licensed in NY and in any event it would be an inconvenience to her to do so, even if that's the best place to sue. Auto accident attorneys can file cases where the accident happened (there is jurisdiction there -- even if both parties live elsewhere). But as a claimant you would be best off having an attorney who can file in the most favorable jurisdiction for YOU, not what's convenient to him or where the bus company wants. Bronx County Supreme Court is regarded by lawyers nationwide as one of the most favorable places to sue for a car accident. Juries are historically very generous in the Bronx. As it's Greyhound and they do business in the Bronx and all over NY you could sue in Bronx County. Note regardless of where you sue, if you sue in a state court the bus company might be able to remove it to a federal court -- although if you start in the Bronx the move would only be to federal court in Manhattan. As the person injured in the car accident I'd speak to a lawyer who practices in the Bronx for an evaluation before filing suit anyplace. Here there may be a major reason to change lawyers, and the Bronx car accident attorney would work things out with the attorney in Philly.
