Attorney Answers Suffolk County Car Accident QuestionHow do I write a verified answer to a complaint? I received a summons from a car accident attorney to answer a complaint filed in Suffolk County Supreme Court against me for a car accident that recently occurred in Riverhead, Suffolk County, New York. I had no insurance at the time. The summons was incorrect in one area where it claims I hit a car when the car hit me. I want to respond, but do not know how to pose my response in the proper way. Is there a proscribed format for a verified answer. My lawyer suggested I write one myself. I live in Suffolk County NY. Thank you.
Attorney's Response to Car Accident Question from Suffolk CountyI would not attempt to answer a complaint yourself. This is a Supreme Court Action pending in Suffolk County. It's significant. There are time limits to respond and certain ways to answer each paragraph plus things known as "affirmative defenses" that if not pled, can be deemed waived. As a defendant there are also discovery demands that you are entitled to as to liability for the car accident, medical condition of the plaintiff(s), etc. You also have a right to depose the plaintiff and they you (where both of you testify under oath as to the facts of the accident and plaintiff(s) as to their medical condition). You are also entitled to have a doctor examine plaintiff to "disprove" their claim. This is almost impossible to do without a car accident attorney. You NEED A LAWYER in Suffolk County to defend you or at least advise you. If at the end you were found not at fault then you could try and recover the cost of litigating the lawsuit from Plaintiff. There is a paragraph that answers have about this. If the suit has any validity and you have any net worth I would hire an attorney soon. Reagrdless you do not need a judgement filed against you.
