Attorney Answers Westchester County Business QuestionHow do I sue a contractor for faulty workmanship? Contractor was hired in 09/09 to install new liner and redo firebox in my home in Mt. Vernon, Westchester County, NY. I did not test fireplace until Thanksgiving. Room filled with smoke. Contractor told me to put bricks in fireplace to raise grate. Room still filled with smoke. Requested contractor to investigate. Contractor re-arranged bricks. Room filled with smoke. Contractor has not return after repeated attempts to contact. My research tells me that dimension of firebox are wrong and needs to be rebuilt. How do I sue them for damages? I don't want to have to hire a business attorney to sue for me.
Attorney's Response to Business Question from Westchester CountyContractors are required to exercise a reasonable standard of care when performing their work. Contractors that deviate from the average standard of care may be sued for the damages that they caused. In this case, you have a contractor that did not built the fireplace properly and as a result the house smokes up. You need to write this guy a letter that you are terminating him as a contractor unless he fixes this within 5 days. If he fails to respond (send the letter certified mail) then hire a new contractor to fix the fireplace. I suggest that you then hire a business attorney in Westchester County to write a lawyer's letter demanding payment. That should get you paid if the contractor knows what's good for him. The business attorney could also advise you how to handle the small claims lawsuit (in a Westchester County small claims court) if needed and then you'd sue the old contractor for the amount of money you have to pay to get it fixed.
