Attorney Answers Brevard County Personal Injury Question1099 employee injured on job I am a DJ for a bar, was jumped from behind by a patron, and was injured in Brevard County, Florida. Also then while trying to maintain job, slip and fell reinjuring and further injuring myself. Do I have any recourse or action available against my employer?
Attorney's Response to Personal Injury Question from Brevard CountyYou could sue them the same way a patron or guest at the bar could sue. Of course, for them to be liable in Brevard Couinty, Florida, they would need to have been negligent in some way. For example, was the patron who attacked you known to be violent or dangerous, or had he been acting out previously that night and should have been ejected? Is the club/bar generally too rowdy and does a poor job of ensuring the safety of people on the premises? When you slipped, was it because there was liquid on the floor that should have been mopped up or had a "wet floor" sign placed over it? Etc.--you would need some grounds to sue, not just the fact that your are injured. Unfortunately, as a 1099 employee, you'd not be covered under their Worker's Comp.
