When involved in an auto accident, most of us think that we’re only entitled to get our vehicle fixed and our medical bills paid. We tend not to think beyond that, but we should as damages as the result of an auto accident can include much, much more.

“You can get paid back for anything that happened in the accident – lost wages, past and future; lost damages of physical property in the past and then future pain and suffering, mental anguish, loss of enjoyment of life—those are humanistic damages and are limitless in injury cases in Florida right now Any wages that you’ve lost, including lost commissions, can be paid back because some people have a history of commission sales and now they’re out and can’t make their commission sales, so they make their salary but their commissions go way down. You can prove those commissions would have been up by looking at the history and gain back your commission sales.”

“Unfortunately, they’re not limitless in medical malpractice cases, but there is no limit on those non-economic damages in Florida right now. There is, of course an up swell of political pressure to try to put a cap on those damages, which I personally disagree with, but that’s a political question.”

How to increase your chances of prevailing in a law suit

There are certain things consumers can do to increase their chances of prevailing in a law suit. Labovick outlined these four:

  • First, get yourself properly checked out by a doctor or at the hospital.
  • Second, hire a good attorney – an attorney who will pay attention to your case and will help guide you through the process.
  • Third, be very honest about what’s going on here so that you can get the proper amount of compensation that’s right for your case.
  • Fourth, gather documentation on the accident as soon as possible. That includes photographs of the cars, photographs of your injuries, property damage information on any vehicles that you can and then you need to treat. Your job as the injured person is to get better.

Labovick tells his clients that his job is to make their case good, but their job is to get better. “The better you are, the better it will be in the long run. No matter how much money I get for you, it will never be enough. If your injury is bad, even if I got you $10 million, you would trade me the $10 million for getting the injury taken away in a minute. I won’t be able to do that. So, get as good as you can get and then we’ll worry about the money secondarily.”
