The first Hydroxycut wrongful death lawsuit is already set for trial in Texas. Injuries stemming from the popular weight loss / energy supplement are being reported in droves after the U.S. Food & Drug Administration (FDA) told consumers to stop using the products due to the risk of liver damage.

The first wrongful death lawsuit is already set for trial in Texas. The case involves Dennis Lopez. According to news reports, Lopez began taking Muscle Tech Hydroxycut Hardcore in November of 2006. He was hospitalized only two months later and died of liver failure shortly afterward. His parents filed a wrongful death lawsuit against the manufacturer, Iovate Health Sciences of New York and Canada, alleging that it knew about the potential dangers of its products, but failed to warn consumers.

More product liability lawsuits likely

Product liability lawyers say that many more cases are likely to be filed now that there is clearer evidence that these products can cause serious injury or death. A class action lawsuit has already been filed against the manufacturer in Canada. Unfortunately, U.S. supplement products such as Hydroxycut are not regulated by the FDA and therefore, are not subject to the same amount of scrutiny as those drugs that are regulated. Even so, manufacturers have an obligation to test their products and warn consumers of any known side effects – before recalls are necessary.

Iovate has recalled over 60 of its products since the initial May 1st 2009 recall notice including variations of these products:
