About the Attorney :
Ryan Scott Nalley is a former private investigator, who is now an attorney at law concentrating in the areas of civil rights, labor and employee rights, fair housing, and general civil litigation. Mr. Nalley has significant experience successfully litigating cases in both in Chicago and its several surrounding counties. He has successfully litigated or otherwise handled both state and federal causes of actions including, but not limited to, The Civil Rights Act of 1964, the Fair Labor Standards Act of 1938, the Fair Housing Act, the Illinois Minimum Wage Law, the Illinois Wage Payment and Collection Act, the American’s with Disabilities Act, the Illinois Human Rights Act, and the Illinois Forcible Entry and Detainer Act, as well as other common law actions and contract disputes. In addition to being a skilled litigator, he is also an effective negotiator, and has been successful in mediation as well as in the courtroom. Mr. Nalley grew up in Pensacola Florida before he moved to Chicago where began studying philosophy at Loyola University of Chicago, and later as graduate student at DePaul University. As an undergraduate, Mr. Nalley spent a year studying in Rome, Italy, and traveled throughout Europe and Israel. However, before he began studying law, he spent four years working full time as a private investigator, during which he traveled the country investigating fraud, and assisting in criminal defense cases, including one death penalty case. It was during his years as private investigator and his witnessing the injustices that good people suffered day to day (and of which he was occasionally a victim of himself) that compelled him to study the law. Verdicts & Settlements
After trial of racial discrimination case in concert with attorneys from the U.S. Department of Housing, he secured a $74,000.00 damages against a defendant that refused to rent an apartment to his client because she was an African American.
In a sexual discrimination case in which a Client was in immenent danger of being wrongfully terminated from her job; and thus her greatly needed medical benefits; not only was the Client saved from being fired from her job and having her medical cut off instnatly; she was given an extra 12 weeks of Family Medical Leave with full insurance coverage, plus $23,000.00 from her employer for her troubles.
After a family of six had been ordered to be evicted from their home, he took on the case and successfully moved the court to vacate the the eviction, thereby saving the family from being evicted from their home. He later represented the family in suing the landlord for discrimination based on religion and familial status in the Illinois Department of Human Rights.
Has won numerous wage and hour cases under various state and federal statutes.
In a case based on the Illinois Minimum Wage Law case in Dupage county, after having one judge substituted, and then loosing a motion to vacate to a favorable judgment before a second judge, he successfully appealed to the Second District Court of Illinois. The appellate court reversed the trial court’s decision holding the the lower court had abused its discretion. On remand, he moved to disqualify the defendant's attorney, and moved for sanctions. In response to the latter motions, the defendants and their attorney, voluntarily withdrew their appearance from the case.
Successfully petitioned the Illinois Joint Committee on Administrative Rules to set standards governing the Department the Illinois Department of Labor's discretion in denying employee petitions to intervene in Minimum Wage Law investigations. The change made it madatory for the Illinois Department of Labor give notice to employees of their right to petition to intervene in instances where the employee had additional evidence or could otherwise show that the Department's findings were erroneous.
