Question Details:A patent attorney does not respond to my inquiries. In 1.5 months he still has not. I sent him a certified letter to respond within 3 days. He is not picking up the letter from the post office, and that gives him more time not to respond. I really do not want to report him, but do I have a choice? I need my money back and my confidential intellectual work (if it is still confidential). I was told today better hire another attorney to proceed with my invention regardless. Not sure which course of action at this point
At this time you should send --by several means; e.g. fax, email, registered mail, fed ex (pick 2 or 3)--a letter (1) letting him know you're firing him; (2) requesting the return of any retainer you'd paid, on grounds he has not actually performed work; (3) requesting your files back; and (4) letting him know that if you do not receive all of the above within, say, 10 business days, you will report him to state bar and also bring a legal action, if necessary. In the meantime, get another lawyer working on your matter.
