Question Details:On public record my father found I had 2 outstanding infractions from 2001 and 2002. Two years ago I paid all outstanding tickets to get my license reinstated. No violations have happened since the reinstatement. If the BMV says I have nothing on my record, how can this other county say they have a bench warrant out on me for a failure to appear from 01/02? If it's not on my record with the BMV do I have to respond to this? I have no criminal record whatsoever. I don't understand why its never been on my record. I could be thrown in jail for the first time if pulled over.
BMV and the court system are two different bureaucracies, and the communication between the two is often less than perfect, at least in part because their jobs overlap only in some aspects of traffic law enforcement.
You had the tickets, and obviously didn't show up for court, if they weren't paid until about 2007 after violations in 2001 and 2002. And while you may have paid the fines for the violations themselves (through BMV, I'm guessing), neither you nor BMV checked with the court. The bench warrant for failure to appear isn't a motor vehicle offense, so BMV has no interest in knowing about it. You'll probably have to pay a fine and/or court costs for the contempt, to make sure you don't get arrested.
