Question Details:I accidentally hit a parked car pulling out of a grocery store parking lot about a week ago. Having never been in any accidents prior to this, I completely freaked out and "fled" the scene. I am completely covered, my insurance company has been notified of the incident and an officer told my husband an active case is currently ongoing. It happened about a week ago and I still haven't heard anything in terms of what's going to happen to me. What's the penalty in Ga for this type of hit and run (i.e. fines, jail, etc) given the circumstances? Also, I am a first time offender.
Fleeing the scene of an accident is a misdemeanor in most states. the crime is punishable up to 6 months in jail and usually carries a fine between $500 and $2000. If you have not been formally arrested for the incident, then you are not required to deal with this charge at this time. the fact that your insurance company is on notice is good so that if and when a claim is made the insurance company will cover the damages to the car if any. I suggest that you hire a lawyer to help you in connection with this matter because you are a first time offender. First time offenders in most states have options to enter into a diversionary program whereby you attend classes and the charges are dismissed upon completion. Hiring a lawyer will give you the best chance of getting into a program as the lawyer will show that there is insurance coverage to compensate the victim and you should be given a chance since its your first offense and no one was physically injured.
