I got a DUI in NJ about 6 years ago and then moved away; now I'm back and want to handle, what do I do? 

Question Details:Wondering what extra challenges I face since the arrest was from so long ago. I hear I may have to spend a couple days in jail for contempt of court? Any truth to that?

You cannot drive in NJ until you satisfy any pending courts and pay the Motor Vehicle Commission its surcharge.  If you are stopped by police, you will be arrested for the failure to appear.  You would have to post bail to be released.

You must consult with a NJ DWI defense attorney.  Often, is is hard for the State to prosecute an old DWI like this, because evidence may be lost, the officer may not remember the facts or the officer may no longer be available to testify against you.  A skilled attorney can get the reports and help you with this serious matter.

You need to hire an attorney to help you our with all of this.  Once you failed to appear in court, a bench warrant for arrest would have been issued.  To clear this all up you will more than likely be fined and serve some jail time; you will then need to serve the sentence for the DUI.

As this can get complicated, your best bet is to have legal representation.  Try to find an attorney who practices in the immediate area to where the warrant would have been issued; they can use their local contacts top your best advantage when arranging to have you turn yourself in.

Remember, warrants don't expire; it's best to clear this situation up now before you possibly get arrested and placed into custody.
