Question Details:I was the passenger in a motorcycle accident. I was seriously injured, and the driver did not have insurance. I filed a civil complaint in Superior Court and had him served. Defendants did not answer within the 20 days, and I need to know what to do next. Everytime I speak with an attorney I get drilled about whether or not there was insurance, THERE WAS NONE. I have to attach assets and garnish wages, but also understand I have to do it all correctly. Can anyone help me get the next step done properly?
The issue first is whether you placed your insurance carrier on notice as you may be able to collect from your insurance carrier - i.e. uninsured motorist coverage. you may have 20K in coverage that you can collect and then you can go after the driver for the balance of whatever judgment you get it court. The next step you need to take is the judgment part. If the deriver has failed to appear, you need to ask the clerk for the form to file a hearing in damages where you can testify as to your injuries. You need to hire a lawyer as i can guess that you have not treated fully and are trying to get money ASAP. You need to go to a doctor and determine the full extent of your injuries before you go to court to prove your damages. I suggest hiring a lawyer, and not getting frustated with the insurance questions.
