Uninsured and held liable for accident. What can I do?

Question Details:I was going through a light that was yellow, then red; I was hit on my drivers side. I was more than 90% through the light whether the insurance company could not determine who was at fault so they said they will make me pay. Can they do this?

I am a lawyer in CT and practice in this area of the law.  the issue in your case is liability.  You have the right to challenge liability and prove in a court of law (i.e. jury trial) that you were not at fault.  What does the police report say about fault?  The police report is usually a strong indication as to who is at fault/will be found at fault.  I suggest that you hire a lawyer to represent you and file a lawsuit against the other driver.  If the damages are not too great (i.e. within the small claims court amount) then file a lawsuit without a lawyer and bring in your witnesses to tell the story.  this may get the insurance company to pay for the damages.  the trial will determine who is at fault.
