Question Details:I have worked for a tribal casino for 4+ years and am non-native. I was recently involved in an investigation that put my manger in a bad light. I feel I am being discriminated and retaliated against since the incident. I have been written up by the manger and HR for "involvement" with the parties I conducted the investigation with. I am no longer eligible for training, dept transfers, or promotions because of this write up. I have also since then been denied all requests for time off that others in my position have been granted. What rights do I have, if any, due to the establishment being tribal?
If you can show that you're being discriminated against because you're non-native, it's quite possible that you can sue for employment discrimination, and you should get a consultation with an attorney who handles these sorts of cases.
These tend to be very difficult cases, that go on for years and put a lot of emotional pressure on the people involved. There are often proof problems, because the employer typically responds with a stack of well-prepared "business reasons" for whatever they did, and the employee then has to show that these reasons were a sham, to cover for the illegal motive.
