Can medical insurance coverage stay open for future medical bills?

Question Details:I was in car accident where 70-year-old man hit me head on and was found at fault. Doctors say in future that they will probably have to do another surgery. I was told that in this state they won't leave medical open in car accidents like they will for workman comp. Is that true?  If so, what do I do about any future operations?

You're going to need to have a lawyer take the case and file suit for you.  The cost of future medical care that won't be covered by insurance directly from the accident is a very legitimate part of your damages.

There are a number of ways that your future medical care could be handled, in a lawsuit verdict or settlement.  One way is simply a cash award, as part of your overall damages, that represents the present value of your expected future medical costs.  Another way is providing insurance coverage for you, although that's rare, and it's not at all unusual for a case like this to end up going to what's called a "structured settlement," with payments to you being made over time, and sometimes including a fund to be drawn on as needed for medical care related to the accident.
