Is it smart to use my husband's lawyer in a divorce?

Question Details:I'm getting a divorce, my husband already has a lawyer that he used for child support case with a woman he cheated on me with. Would it be ok to use this same lawyer to do our divorce?

There is definitely a conflict of interest, as that attorney knows attorney-client privileged information about your husband.  Even if you asked to hire him, the attorney is most likely to turn down representing you due to the conflict of interest.  There are several qualified family law attorneys who can easily assist you with your divorce.  You should consider contacting an attorney referral service for a list of attorneys.
