Question Details:The police gave MIPs to about 20 kids at a homecoming party. There where no parents at the house. My daughter was not drinking but police gave citations to everybody at the party. If she was in the room where people where drinking is she guilty?
I am a lawyer in CT and practice in this area of the law. Unfortunately, this is very common for the police to do - i.e. the police give tickets to everyone in the room regardless if they see them drinking or not. I suggest that your daughter pleads not guilty and you hire a lawyer to go to court to try to get the ticket dropped of pay some type of charitable contribution or do community service to avoid the consequences of the ticket. As you may know, the ticket carries a loss of driver's license for 6 months in most states. Furthermore, some schools kick student athletes off the team for the season if they are caught drinking.
