My 5-year-old daughter got a forehead laceration from a fire extinguisher at a store, what can I do?

Question Details:On Friday 11-13-09 we were shopping at a store and my 5-year -old daughter got a forehead laceration. We took her to the hospital and she got 7 stitches. Can I do anything? If you ask me the fire extingisher is to low so a child can get hurt .

The question is where was the fire extinguisher located in the store and was in positioned in a place that would foreseably cause an injury to a child or customer.  I would need to see the location of the fire extinguisher to make this determination.  I suggest that you take a picture of it and go meet with a lawyer.  These type of claims are hard to prove becasue you are a parent that is charged with watching your daughter  and supervising her in the store.  The store will argue that you failed to watch where she was going and what she was doing.  However, the store will likely not want to take the chances of going to trial and pay you for the injury.  Depending on the size and location of the laceration, there may be significant damages here.  I suggest hiring a lawyer to make a claim.
