Question Details:I have been caring for my disabled mother for about 2 years. I went away for 20 days in August 2009. While I was gone my brother went to my mothers home, had her sign something (she is not sure what she signed but apparently a power of attorney), put her into a state run convalescent facility, took my dog (and won't tell me what he did with her), changed the locks on the home and has told police and neighbors that he has power of attorney and evicted me from the home. I have not been able to access my home, my possessions, etc. Police will not help, they say it is a civil matter. Also, my mom had a living trust of which I was named trustee and power of attorney prior to all this. I need legal help and I don't know where to get help/assistance. I can't even find my dog. From what I have heard my brother signed the home over to himself, even though according to the trust I am to inherit the house. But my mom is alive, so that is not even an issue right now.. I feel my brother has violated many laws and I need to fight him, but I really need help.
Oh contrary my dear -- he can be charged for quite a lot but you have to prove it. Further, if you have issues with respect to the undue influence on your mother, then you need to hire an attorney -- I don't know if your mother would want to either.
