Question Details:Last year my wife was removed from our home in Staten Island, NY by ACS. Her case just recently closed and the worker told me that I retained custody. I know she has a drug problem and now she has disappeared with my two boys, 3 and 2. She has shut off her phone and left her previous residence, also in Staten Island. I am extremely worried for my children's safety? What can I do? I would like to go to the police but I don't have any documentation of my custodial rights. Do I have to wait to obtain that to report her actions to the police? If so, how do I go about getting that documentation?
If you do not have a document that shows that you have custody of your kids, go to the court house and obtain the records showing that you have custody. There has to be some record that was made relating to your custody. There should be some records that you can obtain either at court or ACS. I suggest obtaining the ACS records showing that your wife was removed from the home and explain the situation to the police. While the police are searching for your kids, you can let them know that you will provide them with the documents. However, if you show that your kids are in some danger, then the police should take some action as they have a duty. Go to the police immediately and put your concerns in writing as god forbid something happens to your kids, you will have a paper trail to blame the police for not following up.
