My divorce decree states alimony until death or I re-marry but neither have happened yet he stopped paying citing a recent a Supreme Court ruling. Is this true?

Question Details:I have been divorced for 16 years and my ex-husband has always paid alimony. He stopped paying 4 months ago stating there was a new Supreme Court ruling saying there was a time limitation and he no longer had to pay. Is this true? If this isn't true , what are my legal recourse to collect the alimony? Can I take him back to court for a cost of living increase and get my alimony increased?

I think your ex-husband is probably misreading something he saw in the newspaper or on the web, or someone has fed him the wrong information.  It would be very unusual for the Court to issue a ruling that changed peoples' rights under existing decrees like yours, without that making a huge splash in the news that I doubt you would have missed -- and that wouldn't have left serious "tracks" on the internet, that just aren't there.

You should talk to a lawyer about enforcing your rights.  You can also ask for an increase, but that usually takes something more than a "cost-of-living" justification.
