I suggest that your wife hire an attorney as soon as possible.  With respect to the criminal charge, there are probably first time offender diversionary programs that your wife will be eligible for (assuming this is her first offense) that will result in the dismissal of the charge.  However, if an attorney can get the charges dismissed without using the program, this would be in her best interest.  Moreover, if there is no independent basis for dismissal of the charge, an attorney will be able to make sure that she is accepted into the program and successfully completes it, or, will be able to develop to defend the charge in the event she is ineligible.  Finally, her attorney will be able to evaluate the merit of the civil complaint.  Good luck.
