Seeking compensation for on-the-job injury, what are my rights?

Question Details:I am employee of a company. I was gravely injured by a co-worker who violated company safety rules. Now, I have been placed on workman's comp by the company. I will have permanent damage to my lung. How can I get compensated?

I am a lawyer in CT and practice in this area of the law. You need to fill out a worker's compensation claim form.  You also need to see a worker's comp lawyer asap.  The worker's comp statute is a no fault system where the employer is automatically liable for your injuries.  The question is how to compensate you.  The statute is a bad system as your damages a fixed by statute in terms of the amount you may be paid.  However, you may settle the claim that factors in future medical treatment.  There is no pain an suffering like there is with regular personal injury claims like car accidents.  Make sure you hire  a lawyer asap as your damages sound very serious.
