Settlement Offer for car accident.

Question Details:Should I sign a full release before I get a settlement check? What dollar amount should I cliam for my pain and suffering for an auto accident? I was driving my son's car when the accident happened. The other party accepted fault in the police report. Can I claim for a replacement car? My son is presently deployed on board a Navy ship. I have full authorization to use his car.

You should not sign a release before receiving the settlement check.

It is not possible to determine the amount you should claim for pain and suffering without reviewing the medical reports which document the nature and extent of your injuries.

As for the property damage to the vehicle, if the car can be repaired, you won't receive a replacement car.  If the car is a total loss, the compensation you receive considering the age and depreciated value of the vehicle prior to the accident, may not be sufficient for you to purchase a replacement car.
