What action can I take to have my money refunded by a fraudulent credit counseling agency?

Question Details:I paid $3999 to a "credit solutions" company to handle my loan modification. By egregious negligence the company did nothing at all. I have documentation from my lender proving this. My house is scheduled to be sold at auction. I am working directly with my lender now but it may be too late. I need to find out about possibly filing Chapter13 and also I need to get my $3999 back to put towards a payment for my lender.

I am a lawyer in CT and practice in this area of the law.  I suggest locating a bankruptcy lawyer and filing.  Then, you should file a lawsuit against this company for fraud and breach of contract, among other things.  I suggest that you have a lawyer that is familiar with consumer rights and will take the case on a contingency fee so that you do not have to pay legal fees unless the lawyer collects.
