What happens if a person is on probation and their license is suspended and they are pulled over and ticketed for speeding?

Question Details:My boyfriend is on probation and has a suspended license. He got pulled over last night for driving (the driver was too impaired to drive). They ticketed him for speeding and for driving without a license. What is most likely to happen in this case and will hiring an attorney possibly avoid his probation being revoked?

It is hard to say what exactly will happen because i do not know why he is on probation. So to answer generally depending on the specifics of his probation and the underlying cause he very well may have a potential issue.

The court will have the opportunity at this point to revoke probation or extent it or add additional terms. What they choose to do is something unknown. I would advise you hire an attorney because if the extenuating circumstances (the other individual was intoxicated) can provide a viable excuse he may be able to show the court that the violation was in the overall better interest of the parties. An attorney will also be able to walk you through the process and someone who specializes in this area of law will best know how to work with the other side for the best possible solution for your boyfriend.

Good luck and please let us know if we can further assist you.
