What is reasonable for pain and suffering?

Question Details:My 20 year old daughter was in a car accident - driver fell asleep. She was taken to the hospital by ambulance and released. Doctor and chiropractor bills were about $6000. She's doing fine but still has a back ache now and then. What should pain and suffering compensation amount to? The accident occurred in Kansas about 50 miles outside of Kansas City.

There isn't any mathematical formula for determining pain annd suffering compensation.  It depends on the facts of the particular case regarding the nature and extent of the injuries documented in the medical reports.  As a starting point in negotiations, ask for approximately quadruple the medical bill total.  Don't expect to get that amount.  The insurance carrier will respond with a lower figure and again this is just a starting point for negotiations.  This is not part of pain and suffering, but if your daughter had a wage loss due to her injury, include that amount in her claim.
