What is the penalty for leaving the scene of an accident when there was no bodily injury and no property damage?

Question Details:My son swerved to avoid a deer. He hit a rock and the airbags were deployed. He was driving his car to his dads but the car did not make it and was parked. He went home and went to bed. He filed an accident report on line and spoke with the Eagle police. They asked him to go to the police station. They suspected him of drinking and driving but he said he was not drunk. The next day, they issued him a ticket for reckless driving and leaving the scene of an accident. What is the penalty and should he appear in court with an attorney?

The general rule is that reckless driving and leaving the scene of the accident are fairly serious motor vehicle charges.  In many jurisdictions, they are treated just as seriously as driving under the influence.  Therefore, convictions on these charges could result in criminal penalties, loss of one's license, and insurance ramifications.  Based upon the facts that you have provided, it is possible that a skilled criminal defense attorney could obtain a favorable resolution to these charges that does not involve the aforementioned consequences.  Therefore, I highly suggest that your son hire an attorney.  Good luck.
