Question Details:My son Casey (2 at the time) had his finger cut almost off (at the tip) while bowling on vacation. The guy setting up for bumper bowling told us the fan was shut off and the kids should be fine being around the machinethat he had opened to connect the bumpers to. My 2 year-old stuck his hand inside the machine and something sliced it and it was hanging by a thread. Bills have been paid up to $3000 through Med Pay but we have been billed for an additional $2700. They won't cover it and this has been going on for almost a year now.
You need to get an attorney on the case, and be prepared to sue them. This sounds like a fairly clear case of negligence on the bowling company's part; a 2-year-old can't be negligent, as a matter of law, and if the worker told you it was safe, you won't be found negligent for not keeping your son away from it. What insurance you do or don't have is irrelevant.
