Question Details:There is a police report issued against me for "violent crime, assault without a weapon." I was very verbal with another child and parent at a school that I was an unregistered visitor. The charge was filed 3 days later and I keep looking over my shoulder to see if a police office is around. I would like to go into a police station and turn myself in than be embarrassed. How long does it take for a police report to be processed before they come looking for me?
A police report does not necessarily mean that the DA will file charges. The amount of time that it takes for the District Attorney to determine whether or not to file charges varies considerably from county to county and from office to office in California. If and until the District Attorney files charges the sheriff has no authority to take you into custody or to allow you to surrender. Your best bet is to hire an attorney who will talk to the District Attorney for you. If charges are filed the district attorney may be able to arrange for you to surrender and immediately be released without spending any time in jail. Under no condition should you personally talk to either the police, the District Attorney or the sheriff. If any of these agencies approach you, either give them the name of your attorney if you have one or ask them to appoint an attorney.

Although I do not practice law in the State of California, here are my initial impressions. You should hire an attorney immediately. You attorney will be able to determine if a warrant for you arrest has been, or is likely to be, issued. In any event, you should not simply "turn yourself in" prior to (1) determining whether there is actually a warrant for your arrest, and (2) hiring an attorney to represent you. Good luck.
