If someone shoots a person and they subsequently die, can wrongful death suit be filed?

Question Details:My friends husband was paralyzed by a gunshot wound. The person who shot him was convicted of "attempted discharge of a firearm at an occupied vehicle causing possible bodily harm". Her husband has passed away and the coroners report lists the cause of death as homicide as a result of the gunshot wound. Could the shooter be charged with homicide? Would this fall under the wrongful death law?

I practice in CA.  I do believe the shooter can now be charged with homicide.  Contact the DA's office and inquire.  Wrongful death is a civil suit and, yes, your friend can sue the shooter for wrongful death in civil court.
