Attorney Answers San Diego Car Accident QuestionA golf ball from a driving range hit window on my car parked across the street at a city park in San Diego, CA. The ball was marked "driving range" ball. Are they liable? This is in San Diego, CA, the golf course range is across th street from a city park by the bay where i was parked. I did know the range wa there and there are no signs warning about this. The range has nets that go up about 80ft but one of the workers says the balls do go over because the nets aren't high enough to stop all balls from having accidents with cars. The driving range has a duty to make sure that it operates its business and does not cause harm to those on the street. There is an agrument that can be made that the golf course should take responsibility for their patrons as they are responsible for the activity that casued damage to your car. I suggest that you write a nice letter to the golfing range and let them know what happened and submit the bill for your car. if they fail to pay, file a small claims lawysuit to sue for the damages. A judge should find in your favor, especially if there were precautions that could have been taken (i.e. nets up) to avoid the bal hitting your car.
