Attorney Answers Dallas Car Accident QuestionIf my dog ran into traffic in an auto accident in Dallas, Texas and was hit, am I liable for the driver's deductible for any damage to their car?. Now, 9 weeks later, the driver is suing me for car damage for her accident in Dallas, Texas. Her insurance has paid but she wants me to pay her $500 deductible. I offered $250 but was refused. I would have paid the $500 gladly but she has been threatening me ever since her first contact. She says things like, "We know lots of rich people and have powerful friends", or "You don't want my boyfriend to come over there because it wont be good", or "I am actually considering filing a complaint for threatening me". Am I liable for her deductible?
Attorney's Response to Car Accident Question from DallasThreatening you for payment is against the law, even if you are 100% liable. I suggest that you immediately make a police report and have the person arrested for threatening. Make sure the police come to your house and you provide a complete statement as to exactly what happended as you described to me. As far as your liability, most states have statutes regarding pets. The common denominator in all the statutes is the concent that you must keep your dog restrained and have the responsibility to make sure your dog does not run into public highways as your bear the responsibility. I actually just had a case where my client was driving and hit a dog that jumped out in front of his car. The dog owner's homeowner's insurance carrier paid for the damages. i suggest that if you do not want to refer this to insurance that you ask the person to have an estimate done and you can pay. otherwise, refer it to insurance and pay the deductible. if you get the person arrested, that is enough punishment as no court is going to not make you pay for the car becasue the driver threatened you. This is not the type of case a Dallas auto accident attorney would usually handle.
