Nolle Prosequi of a Sneak-and-Peak Case
West Palm Beach, FL – Ft. Lauderdale Criminal Defense Attorney Leah H. Mayersohn, of the Mayersohn Law Group, P.A., successfully obtained a nolle prosequi of a criminal prostitution case.
Mayersohn’s client, a 60 year old gentleman, entered a massage parlor to receive a standard message. At the close of the massage, he was surprised when the masseuse started performing a sexual act on him, commonly known as a “happy ending” massage. Tipped off by a former customer, law enforcement secretly went into this Boca Raton massage parlor at night and set up cameras without the knowledge or consent of the owners to determine if such activity was taking place. The incident with Mayersohn’s client was caught on tape. Cameras were also set up in a dressing room; and customers who the massage therapist did not try to perform sex acts on were also recorded undressing and being massaged. The Patriot Act allows law enforcement to enter a home or business to look around and set up visual equipment. Its intent is to be used to combat terrorism. Mayersohn believes that it was not the objective or purpose of the patriot act that sneak-and-peak warrants be used for sting operations as stated above.
