I am so sorry for your loss. If your Father had a Will and it has been filed with out your knowledge - or an intestacy proceeding (where there is no Will) has been filed - you can check in the Probate court in the county in which your Father resided at the time of his death. If your brother is running the business I am thinking that he either had some form of ownership rights to do so or the court granted him rights to do so. It may be time to hire an attorney.
