If my husband passed away leaving no Will, what happens to his estate?

Question Details: Our marriage lasted for almost 8 years. The house 2 of us lived in is paid for and titled only with his name. It is sitting on about 30 acres of land. There 2 heirs – me (49 years old) and his son from previous marriage (33 years old). I don’t want to live in the house knowing that somebody waits for me to die to inherit it. I also want his son to get something after his father right away, not when I die. If I choose to sell the house will it become a part of the estate or the funds will be divided some other way between me and his son? Which way?
